Court lets Stockton, Calif. cut retiree health care

SAN FRANCISCO (Reuters) - A federal bankruptcy judge on Friday cleared the way for Stockton, California to cut health care benefits for retirees while it is in bankruptcy proceedings.

Stockton is seeking Chapter 9 protection from its creditors and said that it would cut retiree health benefits while it reorganizes. Retired employees sued to stop those cuts.

Judge Christopher Klein on Friday issued a temporary order denying the bid to stop the benefit cuts, and he said a formal decision was on its way.

Stockton's attorneys had argued that bankruptcy law gave the city wide latitude on how to spend its revenue while it prepares a plan to restructure its finances.

"For the reasons explained in the forthcoming decision of this court, the Application for Temporary Restraining Order and Preliminary Injunction or in the Alternative for Relief from Stay is DENIED," Klein wrote.

"A further order will be entered contemporaneous with the formal decision," the temporary order said.

The case in U.S. Bankruptcy Court, Eastern District of California, is an adversary proceeding, 12-02302, associated with the main bankruptcy case, 12-32118.

Fired MLS coach Nowak sues Philadelphia Union

PHILADELPHIA (AP) - The fired coach of the Philadelphia Union has sued the soccer club's owners over his $373,000 annual contract.

Peter Nowak alleges that his firing violates a contract guarantee through 2015.

Nowak, of Naples, Fla., was fired last month after a 2-7-2 start that had the Union in ninth place in the 10-team Eastern Conference standings. The Major League Soccer club, under interim coach John Hackworth, remained in ninth place Thursday with a 6-10-2 record.

The club's termination letter alleges that Nowak created a hostile work environment, berating and intimidating other employees, and risked his players' safety by making them play while injured. The letter also accuses him of physical confrontations with players and officials; subjecting players to hazing; and insubordination to the club's chief executive officer.

The termination letter, filed with the lawsuit, also asked him to repay a $46,000 marketing advance.

Nowak seeks at least $150,000 from the federal lawsuit, filed last week in Philadelphia. According to the lawsuit, he rejected a separation agreement that would have paid him through the end of 2012.

The lawsuit names two corporate owners, Pennsylvania Professional Soccer LLC and Keystone Sports and Entertainment LLC, as defendants.

The Union did not immediately return a message left Thursday with its media office.

Nowak, who was hired in 2009, alleges in the lawsuit that the contract called for him to be warned about any deficiencies and be given time to cure them but that he instead was dismissed without warning.

Daniel Cormier gets Frank Mir for his final Strikeforce fight

Daniel Cormier has his final Strikeforce opponent, and its a UFC heavyweight. According to USA Today, former champion Frank Mir will fight Cormier, the Strikeforce heavyweight grand prix champ, in a yet-to-be announced Strikeforce event in October or November. The fight will air on Showtime.

Mir's manager tweeted, "@thefrankmir just asked me to tweet for him "that he's very excited about this opportunity and is very grateful to the @ufc for making this fight happen."

Mir last fought at UFC 146, where he was knocked out by Junior dos Santos in the second round of a championship bout. Before the loss to JDS, Mir had wins over Antonio Rodrigo Nogueira, Roy Nelson and Mirko Filipovic.

The match-up is an interesting one for Mir to take, as he has had difficulty with wrestlers in the past. Of the three losses in his last 10 fights, two came to fighters with significant wrestling backgrounds. Cormier is a two-time Olympic wrestler.

He was the surprise winner of the grand prix that started with Fedor Emelianenko and Alistair Overeem as the favorites. He beat Antonio Silva and Josh Barnett on the way to the championship. His record now stands at 10-0. After this bout, Cormier is expected to join the UFC, like every other heavyweight on the Strikeforce roster.

The comments of House of Representatives Speaker John Boehner came after Senator John McCain, the 2008 Republican presidential nominee, blasted the five lawmakers for seeking an investigation into whether Huma Abedin, Clinton's deputy chief of staff, had connections to the Muslim Brotherhood, an Islamist political organization.

Boehner, speaking at a regular news briefing, said "accusations like this being thrown around are pretty dangerous." He said he did not know Abedin, but "from everything I know of her, she has a sterling character."

McCain took to the Senate floor on Wednesday to accuse the lawmakers of making a "sinister" attack on Abedin. Following the custom in Congress, he did not name them but left no doubt he was talking about Bachmann, as well as Representatives Louie Gohmert, Trent Franks, Thomas Rooney and Lynn Westmoreland.

They sent a letter in June to the State Department's inspector general suggesting members of Abedin's family may have connections to the Muslim Brotherhood, which the writers said may be seeking access to high levels of the U.S. government.

Most attention has focused on Bachmann, who earlier this year failed in her bid for the Republican presidential nomination. She has long been criticized by fellow Republicans, among others, for controversial comments and factual errors.

Bachmann defended her actions Thursday on the talk show of conservative host Glenn Beck. "If my family members were associated with Hamas, a terrorist organization, that alone could be sufficient to disqualify me from getting a security clearance,"?Bachmann said, according to a transcript of her remarks. "So all we did is ask, did the federal government look into her family associations before she got a high level security clearance."

Life as a Healthcare CIO: Our Cancer Journey Week 30

Today Kathy visited her oncologist to discuss a 5 year course of anti-estrogen (tamoxifen) therapy. ? ?I've said before that Cancer is chronic disease and although the first phase of our journey ends on July 31 after 8 final radiation treatments, the vigilance for reoccurrence and the medications to minimize risk begins thereafter.

Tamoxifen, a competitive inhibitor for estrogen, makes great sense for Kathy because her breast cancer is estrogen receptor positive - estrogen makes it grow. ? She'll have to watch for endometrial cancer (The American Cancer Society lists tamoxifen as a known carcinogen, stating that it increases the risk of some types of uterine cancer even though it lowers the risk of breast cancer recurrence) and possible memory changes. ? She'll start taking Tamoxifen about 10 days after the end of radiation therapy.

We're preparing to celebrate the end of her treatment phase (chemotherapy, surgery, radiation) and the transition to maintenance and prevention on July 31. ? ?One small complication - having just turned 50, my first ever colonoscopy is scheduled for that day so the champagne may have to wait until August 1.

Starting in August, Kathy's life becomes much easier since she no longer has to commute daily for radiation therapy. ? ?Since Boston has two seasons - winter and road construction - the fatigue of the past 6 weeks has been significantly compounded by sitting in traffic every day for up to 3 hours.

August will be much more settled than the rest of the year thus far. ? Treatment will be done, my office schedule will be iighter, my daughter will be away, and our previous home will have closed escrow. ? What will we do with all that free time?

Our llama and alpacas will move to Unity Farm the week of August 20 (assuming all our fences are finished, our hay arrives, and the folks transporting the herd will be available).

We just learned that our llama is likely pregnant, so we'll have a mama llama. ?The llama gestation period is 11.5 months, so she'll likely have the cria (baby llama) next Summer. ? I welcome suggestions for names. ? The suggestions I've had thus far are Dolly Llama and Ding Dong (as in 'who put the Mom in Mama Llama Ding Dong?')

This weekend we'll visit the alpaca herd in Maine to learn about toenail trimming, vaccinations, and general health assessment. ? I may be an emergency physician but doing procedures on a 150 pound furry camelid will be a learning experience.

After July 31, Kathy will not have another medical appointment until January 29, 2013 when she has a screening mammogram and a followup with her breast surgeon.

Next week will be my last post about this part of the cancer journey. ? It has been an emotional, anxiety-filled time for both of us. ? We're looking forward to maintaining wellness instead of treating illness.

Chinese Silver Price Rises, Gold Up and Down

Chinese silver saw a one percent increase in its price on July 17, 2012, reaching CNY 5,820 ($912) per kilogram and making it the biggest upwards shift of the day on global precious metals markets. US silver finished the day down 0.8 percent to $27.07 per ounce. Indian silver prices inched up 0.6 percent to INR 51,871 ($937) per kilogram. The price of Japanese silver nudged up 0.1 percent yesterday, closing at JPY 690.00 ($8.73) per 10 grams.

After two flat days, the price of Japanese gold bullion inched up 0.9 percent on Tuesday to JPY 4,048 ($51). US gold bullion prices saw a 0.7 percent decline to $1,580 per ounce. After a 0.4 percent increase, Chinese gold bullion finished the day at CNY 327.46 ($51.33) per gram. The price of Indian gold bullion increased 0.2 percent to INR 29,284 ($529) per 10 grams.

At CNY 311.50 ($48.83) per gram, Chinese platinum bar fell 0.6 percent on Tuesday. US platinum bar closed 0.4 percent lower at $1,410 per ounce. The price of Japanese platinum bar declined 0.3 percent to JPY 3,616 ($45) per gram.

Chinese palladium bar finished the day down 0.4 percent to CNY 141.00 ($22.10) per gram. After three straight days of no change, the price of Japanese palladium bar decreased by 0.2 percent to JPY 1,473 ($18) per gram. At $577.00 per ounce, the price of US palladium bar was essentially unchanged.

Fake Aniston movie role lures deadbeat dad

As they say, if it seems too good to be true, it probably is. Now, tack on this corollary: If you're a deadbeat parent who has skipped out on your child support payments and a random call suggests you're in line for a role in the next Jennifer Aniston movie -- well, you might want to think twice about flying home for your close-up.

That's what Joshua Garlathy discovered when he flew in May from Hawaii to Pennsylvania, where he owed over $43,000 in child support payments, according to Pennsylvania paper The Morning Call.

The 40-year-old had been absent from his child's life for 19 years, and as his support payment debt grew, he ultimately decided to live in Hawaii, where extradition was apparently too expensive for local law enforcement. That meant his ex-girlfriend Beth Ann Holderman and bounty hunter Scott Bernstein had to come up with a ruse to get him to return.

Bernstein contacted Garlathy on Facebook,?pretending to be a movie producer, according to The Daily Mail. Bernstein lied that one of his "talent scouts" discovered Garlathy playing guitar in a cafe where he worked, and wanted him to appear in a new rom-com starring Jennifer Aniston called "Banished from Brooklyn."

The whole thing was a story Bernstein invented. But Garlathy bought it, and was handcuffed when his plane landed. He was in fact?greeted by cameras at the airport, but they were for a reality show?making a series on deadbeat parents.

Last Tuesday, after spending 42 days in jail, Garlathy pleaded guilty for willful failure to pay child support, The Morning Call reports. He previously paid?$10,000 toward what he owed, and Judge James T. Anthony put him on 90 days probation and dunned him for the $2,912 plane ticket Holderman had ponied up for the Hawaii-Pennsylvania jaunt.

"This guy thought he was going to be a star of motion picture(s) and change his life and the reverse happened," Bernstein told the Mail. "He was arrested on the plane in front of 250 people."

The Morning Call?says Garlathy is the first man charged in Pennsylvania under a new law that allows the state to charge individuals criminally for failing to pay child support.?

"He always wanted to be famous," said Holderman. "Now, he's famous."

According to a company statement, 1,600 of the layoffs would occur through the company?s 1,050 stores, which is an average of two employees per store. The total also includes 650 Geek Squad division employees. Best Buy?s Geek Squad services appliances and televisions in customers? homes.

The employees? last day will be Aug. 1.

In March, the Richfield, Mn.-based retailer, which has five stores in Memphis, announced plans to shut down 50 stores across the U.S., in a move that would eliminate 400 jobs. The company also announced a new store concept that would center around service, in order to compete with online retailers like Amazon.

No stores in Memphis were included on the closure list.

HBT: Greinke ejected in 1st for spiking ball

Zack Greinke was ejected in the bottom of the first inning against the Astros this afternoon for spiking a ball in the dirt following a close call at first base.

Greinke gave up a leadoff triple to Jordan Schafer before Jose Altuve hit a chipper to Corey Hart at first base. Greinke ran over to the first base bag to catch the throw from Hart, but Altuve was ruled safe on a very close play. Greinke didn?t argue the call, but took out his frustrations by slamming the ball into the ground. He was then given the boot by first base umpire Sam Holbrook. You don?t see that very often.

Brian McTaggart of MLB.com passes along word that that Greinke was saying, ?I?m mad at myself. I?m mad at myself,? so it appears he was taking his frustrations out on himself for losing the footrace. However, Holbrook evidently took it personally. Trigger-happy, much? Brewers manager Ron Roenicke emerged from the dugout to defend his starting pitcher, but he was also ejected from the game. Livan Hernandez is now pitching in relief.

Any scouts who came to see Greinke today are likely bummed, but it?s not a complete lost cause. Wandy Rodriguez, another popular trade target, is pitching for the Astros.

?If you?ve lost your home to foreclosure ?or your home is 'underwater' (you owe more on your mortgage than your home is worth), and you believe it?s because your lender messed up, you?ve got just two more months to apply to the federal government for help.?

?The Office of the Comptroller of the Currency and the Federal Reserve Board offer a program called Independent Foreclosure Review to people who have lost money or their homes because of errors by banks in foreclosure actions during 2009 and 2010. On June 21, the agencies announced an extension of the deadline to file for the free review: instead of the end of July, you now have until September 30, 2012.

?There?s also the possibility that banks are getting hit twice for the same errors. The same banks ? Bank of America (BAC), JPMorgan Chase (JPM), Citigroup (C), Wells Fargo (WFC), and Ally Financial (ALLY) (formerly known as GMAC) ? that are subject to the review program agreed to a $25 billion settlement in February 2012. That landmark case settled charges that the banks routinely approved loans without checking their facts, a practice known as 'robo-signing.'?

?To recap, the price-to-income ratio is a useful metric when gauging where current home values stand in relation to their historic norms, and when comparing the affordability of housing across different cities in the United States. The ratio compares the median price of homes to the median level of household income in a given area. Specifically, we used the metro-level Zillow Home Value Index, which is a measure of home values for a given metro, as well as median household income for that metro. Median household income is currently available through 2010. After that year we calculated the median household income by estimating it via Bureau of Labor Statistics wage growth rates. In this research brief we consider 133 metros and the United States as a whole.

"Compared to their historical averages, measured from the first quarter of 1985 to the fourth quarter of 1999, 23 metros are below their historical average, while 106 metros and the United States as a whole are above their historical average. Four of the metros are exactly at their historical mean. The United States currently has a price-to-income ratio that is equal to 2.8, which puts it at 11% over its historical average. Eighty-two metros are still more than 10% over their historic average. Six metros have overshot their historical average by more than 10%.

"Surprisingly, more metros are currently over their historical average than last year at the time of our last brief. Some of that can be explained by home prices appreciating a bit and some can be explained by sluggish income growth. Both of these factors will increase the price-to-income ratio.?

?A significant amount of home equity lines of credit will reach the end of their draw period beginning in 2014, about the same time the Federal Reserve plans to end its downward pressure on interest rates.?

?More of these loans are already falling into trouble. The delinquency rate on HELOCs increased to 1.78% in the first quarter from 1.69% at the end of last year, according to the American Bankers Association."It will be many quarters before delinquencies on home equity loans get back to anything close to normal," said ABA Chief Economist James Chessen.?

?'Approximately 58% of all HELOC balances are due to start amortizing between 2014 and 2017,' the OCC said. 'Housing price declines have led to questions for the banking industry about carrying values and allowance levels that support home equity portfolios.'?
